I'd like to think you had some recourse over that ombudsman perhaps?
You mention passengers, could they be witnesses?
Obviously a car fault, Kia should have footed the bill. Seems like the insurance company shafted you
Tried all that at the time to no avail... unfortunately, the autonomous vehicles act wasn't signed into law until this year. That little box you tick on the head unit every time says 'you assume all liability over the vehicle'. And let's face it, the insurance companies will shaft anyone and everyone to save a few quid.
The accident team were VERY good at getting me back on my way I'll give them that.
*I had an autistic passenger so was classed as a priority
To add insult to injury, during my 10 months with the hire car, a shitty petrol shoebox compared to the luxurious electric behemoth... someone crashed into me too! When I gave the hire car back I was forced to pay 2 lots of excess before they'd give me my car back. Something to do with the other party's insurer fighting the liability, even though I had an independent witness and the other party admitted liability to us both.
I tried taking the insurance company to the ombudsman over the 'reasonable timeframe' of repairing my EV6 and the fact I was getting (at the time) FREE electricity from the local Lidl Vs having to pay a grand total of £800+ in petrol. The ombudsman threw it out citing the insurance company had complied with 'reasonable timeframe'.
I argued that contract I signed didn't have any allowances for COVID and / or global conflicts (which is what they were using as an excuse for that delay in acquiring parts) but, they still sided with m insurance company. All I was asking for was the difference in petrol monies to comparable electricity costs for the last 6 of the 10 months (£400) but they wouldn't have it.
Anyways, I'm currently having to take my own insurance company to court to get back my own excess payment for the other accident in the hire car. The other party's insurer settled out of court but, they still haven't paid me out, 2 years after the initial accident.
The whole insurance system is a crock of shit. It's been designed by fat cats to get them rich, and it's been approved by fat cats in government who get even richer. Even the ombudsman isn't impartial. It's all rigged so that the peasants have to pay their money to the man for it never to be seen again. It boils my piss!
